PAYMENT OF THE PRICE

1. The client is entitled to pick up and use the bicycle for the time specified above only after the payment for the bicycle lease has been settled in accordance with this Contract.
    
   The client shall pay the price, eventually an instalment, either in cash or by credit card at the premises of VB MALLORCA CYCLING CENTER S.L.U (Hotel Java****, Carrer de la Goleta, 07610, Playa de Palma, Mallorca, Spain), or via bank transfer to the account of VB MALLORCA CYCLING CENTER S.L.U. stated in this Contract. The client is fully responsible for proper and timely payment. In the case of bank transfer payments (deposit or balance), a payment is not considered settled until the whole amount has been credited to the bank account of VB MALLORCA CYCLING CENTER S.L.U.
    
   If the deposit and/or balance have not been settled in full by the due date, VB MALLORCA CYCLING CENTER S.L.U. is entitled to withdraw from this Contract. VB MALLORCA CYCLING CENTER S.L.U. may offer the client extra time to settle the payment(s). If the payment has not been settled 16 days prior to the start of the lease period, the client will be considered to have withdrawn from this Contract, and VB MALLORCA CYCLING CENTER S.L.U. will be entitled to claim compensation (cancelation fee) of 100% of the full price. The client shall pay the full compensation to VB MALLORCA CYCLING CENTER S.L.U.
    
   For payments made via the Stripe payment gateway (online card payment) and for card payments on site at the premises, a fee of 3% of the total order amount is charged. This fee is charged for payment processing and is non-refundable.
    
   In the case of bank transfer payments, a fee of up to €15 may be charged for each incoming payment. This fee is charged by the receiving bank for processing the incoming transfer.
    
   In addition to the full payment of the price, the handover of the bicycle is also conditional on the provision of security (deposit / card pre-authorisation) in accordance with the article SECURITY DEPOSIT AND CARD PRE-AUTHORISATION of this Contract.

CLIENT OBLIGATIONS

1. The client is the exclusive user of the rented bicycle. It is strictly prohibited using of the bicycle by the third party.
    
   The client may not provide the bicycle to a third party for use.The client may collect or return the leased bicycle only during the opening hours of www.mallorcacyclingcenter.com.If the client does not collect the reserved bicycle at the arranged time and date, the reservation of the bicycle (including the reservation payment and any deposit paid) will lapse with no right to claim compensation, unless there is another arrangement between the client and VB MALLORCA CYCLING CENTER S.L.U.
    
   The client bears full responsibility for any damage to the bicycle and/or part thereof for the whole lease period as a consequence of damage, theft, loss or destruction no matter whether the damage was caused by the client or a third party.
    
   The client undertakes to use the bicycle in such a way as to prevent any damage to it. The client shall report any accident or damage to the bicycle to VB MALLORCA CYCLING CENTER S.L.U. immediately they find out about it. This should be done personally at the place where the bicycle was leased or potentially by calling +34 669 410 039 or +420 777 871 045. If the client fails to do this, they will be responsible for any damage that occurs due to failure to comply with such obligation.
    
   If the client had a positive alcohol text after the accident, the arranged insurance becomes void.
   Any defect to the bicycle must be reported to VB MALLORCA CYCLING CENTER S.L.U., which will then decide on the repair. The client must not perform any repairs to the bicycle themselves.
   The client may not perform any adjustments to the bicycle or dismount any parts of the bicycle without the approval of VB MALLORCA CYCLING CENTER S.L.U.The client undertakes to secure the bicycle when parked so that it does not get damaged, stolen, lost, or destroyed.
   If the bicycle or any of its parts (inner tube, puncture kit, etc.) has been damaged, stolen, lost, or destroyed, the client undertakes to pay the incurred damage to VB MALLORCA CYCLING CENTER S.L.U. in full. The amount of the compensation will be determined by VB MALLORCA CYCLING CENTER S.L.U. according to the extent of the damage and the value of the bicycle or part thereof at retail prices (including servicing).
    
   If the bicycle is not returned within the arranged deadline, we will automatically charge additional days as stated in the pricelist at www.mallorcacyclingcenter.com.The rented bike must be returned clean and washed by the customer. In case of returning a heavily soiled bike, a penalty fee of €30 will be charged in favor of the rental company.

VB MALLORCA CYCLING CENTER S.L.U. OBLIGATIONS

1. VB MALLORCA CYCLING CENTER S.L.U. shall hand the bicycle over on the day and hour the lease starts. Both the handover and acceptance of the bicycle are confirmed in the handover and acceptance record.
    
   The bicycle must be handed over in such technical condition corresponding to the purpose it is intended for.
    
   If the ordered bike is not available (due to a technical issue or it is not in a rideable condition), VB Mallorca cycling center S.L.U. may provide the client with a similar bike in the same price range that will fully replace the ordered bike. In case of changing to a more expensive/cheaper bike, the price will be adjusted according to the current price list with prior notice to the client. The client has the right to refuse a replaced bike in a different price range without any cancellation conditions.
    
   If VB MALLORCA CYCLING CENTER S.L.U. is prevented from complying with its obligations by an emergency that VB MALLORCA CYCLING CENTER S.L.U. could not predict, overcome or avoid (hereinafter an Exceptional Obstacle), than during such Exceptional Obstacle VB MALLORCA CYCLING CENTER S.L.U. is not considered in default with its contract liabilities. Exceptional Obstacles include, in particular, military conflict, embargo, terrorist attack, epidemic, natural disaster, or intervention by a public authority.

WE CAN HELP IN AN EMERGENCY – SERVICE PACKAGE (INSURANCE AND SOS ASSISTANCE); SUPPLEMENTARY INSURANCE

1. The rental price includes a compulsory service package that contains only basic bike insurance. Mandatory insurance FULL contains SOS ASSISTANCE that guarantees you our assistance in the event of an accident or mechanical defect anywhere on the island (Mallorca, Spain) free of charge. SOS ASSISTANCE is apply only to mechanical problems with the bike (broken frame, non fuctional derrailleur, broken chain and others). SOS ASSISTANCE is not apply to transport people under the influence of alcohol, transport people due to fatigue, or bad weather conditions.The insurance does not cover any type of bike theft or damage caused through the fault of the client over and above the basic insurance. The insurance does not cover expenses for a damaged tube and a tire on a rented bike. In addition to the compulsory service package, you can arrange supplementary bike (and other items) insurance under the conditions indicated on the website www.mallorcacyclingcenter.com as well as in this document.
   MANDATORY BASIC INSURANCE (bike damage up to EUR 250 according to the VB MALLORCA CYCLING CENTER S.L.U. tariff. Insurance does not cover SOS asisstance which is possible to reorder due to tariff VB MALLORCA CYCLING CENTER S.L.U. The insurance does not cover any type of bike theft). Insurance possible only for bicycles of the categor: Start
   CLASSIC INSURANCE (bike damage up to EUR 600 according to the VB MALLORCA CYCLING CENTER S.L.U. tariff, and 1 x SOS ASSISTANCE FOR FREE and 50% sale for next one, that guarantees you our assistance in the event of an accident or mechanical defect anywhere on the island (Mallorca, Spain) free of charge. The insurance does not cover any type of bike theft). Insurance possible only for bicycles of the categor: Start, Classic, Top
   FULL INSURANCE (any and all bike damage according to the VB MALLORCA CYCLING CENTER S.L.U. tariff, and unlimited SOS ASSISTANCE that guarantees you our assistance in the event of an accident or mechanical defect anywhere on the island (Mallorca, Spain) free of charge. The insurance does not cover any type of bike theft).
   All the damages is necessary to report in a day of accident. When is bike available is it possible to pick it up a day before after 6 pm with no charge. Insurance possible only for bicycles of the categor: Start, Classic, Top

OPERATING RULES OF THE LEASE ESTABLISHMENT

1. It is possible to collect, set up, and return the leased bicycle strictly within the opening hours of the lease establishment Mallorcacyclingcenter.com.
    
   The store is open every day of the week from 9 a.m. to 12 p.m. and from 3 p.m. to 7 p.m., and the recovery services are open until 10 p.m.
    
   You can find current information and possible changes to our opening hours on our website at www.mallorcacyclingcenter.com
    
   The return of the bike on the last day of rental is always until 5:30PM during the opening hours of the shop. If the bicycle is not returned within the arranged deadline, we will charge additional days as stated in the relevant pricelist (the same conditions as for a new order will be applied).
    
   The bicycle must be returned washed and clean. Store assistants have the authority to decide whether the bicycle is clean or not. The security (deposit) for the rented bicycle is governed by the article SECURITY DEPOSIT AND CARD PRE-AUTHORISATION of this Contract.
    
   The client undertakes to report any damaged parts, or if the leased bicycle was crashed, on the same day of the event, however no later than the day after.
    
   If the bike is available for the client a day early, it can be collected after 6:00 pm while the rental price will only be charged from the next day.

GENERAL REGULATIONS AND APPLIED LEGISLATION

1. This Contract has been concluded in written form. Any amendments to this Contract shall be made in written form. No oral agreements can be applied.
    
   Any legal nullity of individual parts and provisions of the general lease conditions are without prejudice to the validity of the arranged terms and conditions.
    
   Any terms and conditions between the client and VB MALLORCA CYCLING CENTER S.L.U. not addressed in this Contract fall under Spanish law (with the exception of obligatorily applicable consumer law regulations that can be applied in legal relations with the relevant client). If the obligatorily applicable regulations do not state otherwise, any dispute between the client and VB MALLORCA CYCLING CENTER S.L.U. is to be decided on by courts with local jurisdiction in Mallorca (Spain).

WITHDRAWAL FROM THIS CONTRACT

1. VB MALLORCA CYCLING CENTER S.L.U. is entitled to withdraw from this Contract only in the cases specified in this Contract or in generally binding legal regulations.
    
   VB MALLORCA CYCLING CENTER S.L.U. is entitled to withdraw from this Contract if the fulfilment of its obligations is hindered by an Exceptional Obstacle and it notified the client of this fact in advance prior to the start of the lease (especially prior to the start of the camp). In such a case, VB MALLORCA CYCLING CENTER S.L.U. shall return any paid deposit to the client; however, VB MALLORCA CYCLING CENTER S.L.U. is not obliged to pay any additional compensation to the client.
    
   The client is entitled to withdraw from this Contract at any time prior to start of the lease without providing a reason. This Contractual relationship expires and is cancelled on the day the written notice of withdrawal from this Contract (cancellation) is delivered to VB MALLORCA CYCLING CENTER S.L.U.
    
   The client understands that their withdrawal from this Contract will cause VB MALLORCA CYCLING CENTER S.L.U. to incur damage in the form of additional investment to find another client to replace the original client. To compensate for such damage, this Contracting parties have arranged a cancelation fee the client shall pay to VB MALLORCA CYCLING CENTER S.L.U. if they withdraw from this Contract.
    
   Cancelation fee:
      a) 60 % of the full price of the bicycle lease if the client withdraws from this Contract 90 and more days before the first bicycle reservation day,
    
      b) 80 % of the full price of the bicycle lease if the client withdraws from this Contract between 89 and 15 days before the first bicycle reservation day,
    
      c) 100 % of the full price of the bicycle lease if the client withdraws from this Contract less than 15 days before the first bicycle reservation day

PROCESSING OF PERSONAL DATA

1. VB MALLORCA CYCLING CENTER S.L.U. will process the client’s personal data stated in this Contract or the data the client provides to VB MALLORCA CYCLING CENTER S.L.U. to conclude and administer this Contract. VB MALLORCA CYCLING CENTER S.L.U. will use these data to comply with its legal obligations, to send commercial messages to the client (with the client’s consent), or for other purposes to which the client has consented
    
   The processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the relevant Czech legislation, and in accordance with the Principles of Personal Data Processing – Information for Clients and Business Partners published on www.mallorcacyclingcenter.com in the Privacy Policy section, where there is a detailed description of how VB MALLORCA CYCLING CENTER S.L.U. will handle the client’s personal data, what data is stored, and how the relevant data are used and transferred. The Principles of Personal Data Processing also include a list of the client´s rights related to the processing of their personal data, especially the right to information, correction, data erasure, and the right to revoke consent to the processing of the client’s personal data.
    
   In relation to the personal data processing, VB MALLORCA CYCLING CENTER S.L.U. declares that (i) VB MALLORCA CYCLING CENTER S.L.U. processes personal data in accordance with legislation, (ii) VB MALLORCA CYCLING CENTER S.L.U. assistants authorized to process personal data are bound by a confidentiality obligation, or are under a statutory confidentiality obligation, (iii) VB MALLORCA CYCLING CENTER S.L.U. takes all the necessary technical and organizational measures to ensure the security of the personal data, and (iv) if the security of the personal data has been violated with a consequent risk of damage to a person’s rights and freedoms, VB MALLORCA CYCLING CENTER S.L.U. will immediately inform the public authority and the subject whose data have been affected.

SECURITY DEPOSIT AND CARD PRE-AUTHORISATION

1. The handover of the bicycle is conditional on the client providing security for the event of damage, loss, theft or non-return of the bicycle, either in the form of (a) a payment card pre-authorisation (secure storage of the card, a so-called mandate – no amount is blocked or charged), or (b) a temporary hold of an amount on the payment card (deposit). The form of the security is determined by VB MALLORCA CYCLING CENTER S.L.U., in particular according to whether it is the client’s first or repeated rental and the length of the rental.
    
   The amount of the security depends on the category and value of the rented bicycle according to the current table published at www.mallorcacyclingcenter.com and available at the store. The stated amount is always a maximum; only the damage actually incurred may be charged, up to the amount of the security.
    
   For group rentals, the security is provided by the group leader (main client) for all bicycles handed over. Individual group members may, by agreement with VB MALLORCA CYCLING CENTER S.L.U., provide their own security for their bicycle; the group leader’s security is reduced accordingly.
    
   If no damage occurs, the security is released (the mandate is cancelled or the hold is released) no later than 72 hours after the proper return of the bicycle. If damage occurs, VB MALLORCA CYCLING CENTER S.L.U. is entitled to set it off against the security; the client will be informed of any charge and its reason.
    
   The security does not affect the arranged insurance; it covers in particular the deductible and damage not covered by the insurance (e.g. bike theft).
